Roger Rodas’ Widow Files Lawsuit Against Porsche For November 2013 Accident That Killed Paul Walker and Her Husband

The wife of Roger Rodas, the driver of the Porsche Carerra GT that killed Fast and Furious actor Paul Walker, has filed a lawsuit against Porsche Cars North America.

In the lawsuit, Kristine Rodas claims the Carerra GT was only going 55mph and did not have the basic safety features that could have saved the two men. Rodas filed the suit in a Los Angeles courthouse on Monday, claiming wrongful death, negligence and product liability. She’s asking for a jury trial to take place.

Rodas’ assertion is that the vehicle needs to have a crash cage and a heavily-secure fuel cell; something found on racing vehicles and what the 2005 Carreta GT was designed with.

In the suit, she states a properly working crash cage could have saved the lives of both her husband and the actor. Even if there was no crash cage for protection of the fuel tank, the fire could have been prevented if the vehicle was outfitted with an appropriate racing fuel cell.  These fuel cells are not generally compromised even in serious car wrecks, which would prevent the type of explosions seen in the crash of the two men.

A Los Angeles County Coroner’s report was released in January that said the main cause of the wreck with speed – the vehicle was traveling more than 100mph – and did not have faulty mechanics when it swerved out of control.

Both the California Highway Patrol and the Los Angeles County Sheriff’s Department said the same thing.

According to Rodas, the car was only going 55mph and had a failure in its suspension system that led to the accident.
